Welcome to positivitysparkles.com (the “Website”), operated by Positivitysparkles LLC (“Company,” “we,” “our,” or “us”). By accessing or using the Website, purchasing our products, or interacting with our content, you agree to these Terms & Conditions (the “Terms”). If you do not agree, please discontinue use.

1) Acceptance of Terms

By using the Website, you confirm that you are at least 18 years old (or have the consent of a parent/guardian) and that you have read, understood, and agree to be bound by these Terms and any policies referenced here, including our Privacy Policy, Refund & Returns Policy, and Disclaimer.

2) Changes to the Terms

We may update these Terms at any time. Changes are effective when posted on this page with the “Last Updated” date. Continued use of the Website after changes constitutes acceptance.

3) Products & Services

• Digital Products: We offer digital downloads, guides, journals, online courses, interactive rooms, and a membership (“The Sanctuary”). Digital items are delivered electronically upon purchase.
• Physical Product (Deck): We may offer one physical oracle deck produced and shipped by a third-party vendor. Production, shipping timelines, tracking, and any manufacturing defects are handled by that vendor’s processes and policies.
• No Medical or Therapeutic Services: Our offerings are for educational and self-help purposes only. See our Disclaimer.

4) Accounts, Access & Security

Some features may require an account. You are responsible for safeguarding your login credentials and for all activities under your account. Notify us promptly of any unauthorized use.

5) Pricing, Payments & Taxes

• Prices are listed at checkout and may change without notice prior to purchase.
• Payments are processed through trusted third-party processors (Stripe, PayPal, and WooCommerce gateways). By purchasing, you represent you are authorized to use the payment method.
• Where applicable, sales tax or VAT is calculated and collected at checkout. You are responsible for any additional taxes, duties, or fees required by your jurisdiction.

5a) Lifetime Membership Access

“Lifetime” access to The Sanctuary membership means access for as long as positivitysparkles.com and the Sanctuary membership tier continue to operate. It is not a guarantee that the Service will run indefinitely. If we discontinue the Service, sell the business, or retire the membership tier, lifetime access ends with it, and purchase of lifetime access does not entitle you to a refund, credit, or compensation on discontinuation, except as provided by the 14-day guarantee in Section 7. Lifetime access reflects the membership as it exists at time of purchase; features may be added, changed, or retired over time.

6) Delivery of Digital Items

All products sold on positivitysparkles.com are digital. After successful payment, you’ll receive access immediately via on-screen links, email delivery, or your account dashboard. There is no physical shipping. If you don’t see delivery within a reasonable time, check spam/junk folders and then contact us at olya@positivitysparkles.com. 7) Refunds, Replacements & Order Issues

• Digital Products: All sales are final once delivered/accessed. Because delivery is instant and irrevocable, we do not offer refunds, returns, or exchanges unless required by law — with the one exception below.
• Lifetime Sanctuary Membership — 14-Day Guarantee: The one-time lifetime membership may be refunded in full within 14 days of purchase, no questions asked. Purchases made by card include a private self-service refund link in the purchase confirmation email; using it returns the full amount to the original payment method automatically and ends membership access. Alternatively (and for purchases made through PayPal or WooCommerce), email olya@positivitysparkles.com within the 14-day window. This guarantee applies once per purchaser, to the lifetime membership only.
• Physical Deck: If your deck arrives damaged or misprinted, contact us within 7 days of delivery with photos. We will coordinate with the third-party printer regarding a replacement or refund in line with their policy.

8) License & Permitted Use

Upon purchase of a digital product, we grant you a personal, non-exclusive, non-transferable license to use the file(s) for your individual use only. You may not share, resell, sublicense, reproduce, distribute, or make derivatives for commercial purposes without our prior written consent.

9) Intellectual Property

The Website and all content (including text, images, graphics, videos, courses, downloads, and trademarks) are owned by or licensed to Positivitysparkles LLC and are protected by intellectual property laws. Unauthorized use is prohibited.

10) User-Generated Content (Comments, Testimonials)

If you submit or post content (e.g., comments, testimonials, reviews), you grant us a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, modify, publish, translate, distribute, and display such content in any media, subject to our Privacy Policy. You represent you own or have rights to such content and that it does not infringe any third-party rights. Testimonials submitted through the Website are published only with your explicit consent and may be withdrawn by contacting us.

11) Prohibited Use

You agree not to: (a) violate any law or third-party right; (b) interfere with Website security or operation; (c) copy, scrape, or harvest content; (d) upload malicious code; (e) share or resell digital files; or (f) misrepresent your identity or affiliation.

12) Third-Party Services & Links

We may link to or integrate with third-party services (e.g., payment processors, email providers, printers/fulfillment). We are not responsible for third-party content, policies, or actions. Your use of third-party services is governed by their terms.

13) Affiliate Disclosure

Some links may be affiliate links. If you click and purchase, we may earn a commission at no additional cost to you. We only recommend items we genuinely believe add value.

14) Disclaimers (No Professional Advice)

Our products and content are for educational and self-help purposes only and are not medical, psychological, legal, or financial advice. Results vary and are not guaranteed.

15) Limitation of Liability

To the fullest extent permitted by applicable law, Positivitysparkles LLC and its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from or related to your use of the Website or products.

You agree to indemnify, defend, and hold harmless Positivitysparkles LLC and our personnel from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Website or violation of these Terms.

17) Governing Law & Dispute Resolution

These Terms are governed by the laws applicable to the place of organization of Positivitysparkles LLC, without regard to conflict-of-laws principles. Any dispute shall be resolved through good-faith negotiations; if unresolved, you agree to submit to a competent forum consistent with that governing law.

18) Force Majeure

We shall not be liable for any delay or failure due to causes beyond our reasonable control, including acts of nature, labor disputes, internet outages, or third-party service interruptions.

19) Miscellaneous

• No Waiver: Our failure to enforce any provision is not a waiver of that provision.
• Severability: If any provision is deemed invalid, the remaining provisions remain in effect.
• Assignment: You may not assign your rights; we may assign in connection with a merger, acquisition, or sale.
• Entire Agreement: These Terms and referenced policies are the entire agreement between you and us regarding the Website and products.
• Electronic Communications: You consent to receive communications electronically (e.g., email, on-site notices).
